Purpose and who we are

The purpose of this Privacy Policy is to describe how Profitexia ("Profitexia," "us," "we," or "our") collects, uses, stores and shares information about you through our websites owned and controlled by us, including (collectively referred to herein as the "Site") and what rights you have. What Information this Privacy Policy Covers

This Privacy Policy covers information we collect from you through our Site. Some of our Site’s functionality can be used without revealing any Personally Identifiable Information (also referred to herein as "personal data"), though for features or services related to downloading trial software or buying our software, Personally Identifiable Information is required. In order to access certain features and benefits on our Site, you may need to submit, or we may collect, "Personally Identifiable Information" (i.e., information that can be used to identify you).

Personally Identifiable Information can include information such as your name, address, e-mail address, phone number, IP address, payment information and information about what services you have and how you use them, among other things. You are responsible for ensuring the accuracy of the Personally Identifiable Information you submit to Profitexia. Inaccurate information may affect your ability to use the Site, the information you receive when using the Site, and our ability to contact you. For example, your e-mail address should be kept current because that is one of the primary manners in which we communicate with you.

How We Use the Information?

According to current data protection regulations, personal data may only be collected for "specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes...". In addition, organisations must have a valid, legal reason to process personal data. This is called a legal basis.

In order for us to legally process your personal data, one of the following reasons is required:

  • The processing is necessary for us to fulfill our agreement with you,
  • The processing is necessary for us to fulfill a legal obligation that we have (i.e., if we have a legal obligation to do something under another law),
  • Treatment is necessary for the legitimate interests of Profitexia and your interests in protecting your personal data does not take precedence (balancing of interests), or
  • In specific cases, after you have given your consent to the particular treatment.

In order for us to provide our services and products to you, we need to process and manage your personal data. The following are examples of the purposes for which we treat your personal data and for which legal basis we do this.

Certain treatment may require the legal basis of consent. In such cases, we will collect your consent for the appropriate treatment before such treatment begins.

Provision of services

We process your personal data to the extent that we need to identify you as our customer or user in order to be able to fulfill our agreement with you regarding the delivery of services and products. We also process your personal data for our administration and billing of services, to handle complaints, to assist you in questions about your service or agreement when contacting our Customer Service, and otherwise to exercise our rights and fulfill our obligations under our agreement with you.

Development of services

We process data to develop, optimize and manage our operations in terms of our services, products and processes. For this purpose, we may also compile statistics for analysis needs.

Our legitimate interests for this treatment are to optimize our services, products and processes to provide the best services to our customers in the long term.

Compliance with laws

We process personal data in order to fulfill our statutory obligations.

Examples of treatment that may occur for this purpose are the storage of billing documents to comply with our obligation under the Accounting Act or disclosure of information at the request of law enforcement authority.

How is the data collected?

  • We collect personal data when you become a customer of us or download a trial version of the program and provide us with information. We also collect personal data when you otherwise communicate with us, for example, to get some information or when you choose to answer a questionnaire that we have sent to you or subscribe to our newsletters.
  • When users come to our Site, we may track, collect and aggregate information indicating, among other things, which pages of our Site were visited, the order in which they were visited, when they were visited, and which hyperlinks were "clicked." We also collect information from the URLs that links to our Site. Collecting such information may involve logging the IP address, operating system and browser software used by each user of the Site. We may be able to determine from an IP address a user’s Internet Service Provider and the geographic location of his or her point of connectivity. We use your IP address to help diagnose problems with our server. We do not link IP addresses to any Personally Identifiable Information. This means that a users session will be tracked, but the user will be anonymous.

How long will the data be saved?

We never save personal data for a longer period than necessary. The data we collect and generate when using our services and products is processed for different purposes. Therefore, they are also saved for a different period of time depending on their use and our obligations under law:

  • Unless otherwise stated below, we will store most of your Personally Identifiable Information as long as you are a customer with us or as long as you choose to receive information about new versions, offers or newsletters. If you choose to not receive information about new versions or offers, the personal data are deleted (or anonymized) after a maximum period of 12 months, except when we by law are required to save them for a longer period of time (for example, according to the Accounting Act).
  • Our case history from support cases is deleted after a maximum of 36 months from the support date.
  • The personal data we have due to a legal obligation is saved as long as the current law requires.

To whom is the information given?

Under certain circumstances, we may share information about you as described below.

Government Authorities, Legal Rights and Actions
Profitexia may share your Personally Identifiable Information with various government authorities in response to subpoenas, court orders, or other legal process; to establish or exercise our legal rights or to protect our property; to defend against legal claims; or as otherwise required by law. In such cases we reserve the right to raise or waive any legal objection or right available to us. We may also share your Personally Identifiable Information when we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of Profitexia, the Site, our users, customers, or others; and in connection with our Terms of Use and other agreements.

Disclosure to Acquirers
Profitexia may disclose and/or transfer your Personally Identifiable Information to an acquirer, assignee or other successor entity in connection with a sale, merger, or reorganization of all or substantially all of the equity, business or assets of Profitexia to which your Personally Identifiable Information relates.

How are the data protected?

We take appropriate physical, technical and administrative security measures, consistent with industry standards, to ensure that all Personally Identifiable Information we treat is protected from unauthorized access. Only a limited proportion of employees have access to the information about you and their management of the information is strictly regulated. Because the Internet is not a 100% secure environment we cannot guarantee the security of Personally Identifiable Information, and there is some risk that an unauthorized third party may find a way to circumvent our security systems or that transmission of your information over the Internet will be intercepted. Please note that e-mails communications are typically not encrypted and should not be considered secure.

Your rights

You are entitled to know what we do with your personal data, such as when and how your personal data is processed and why. You may also, in some cases, obtain your personal data or have them moved, corrected, deleted or blocked. Below we list what rights you have and how to use them.

Right of access

You are entitled to receive information about what personal data we have collected about you (registry extract). Requests for such excerpts shall be made by e-mail.

Right to rectification

We are responsible for ensuring that the personal data we process is accurate and up to date. If you find that we have incorrect information about you, you are entitled to request that we correct such information. You also have the right to supplement such personal data as you deem missing and which are relevant to the purpose of processing your personal data.

If the information has been corrected on your request, we will ensure that we have provided the updated Personally Identifiable Information to those that we have shared your Personally Identifiable Information with earlier. This does not, however, apply if it proves impossible or imposing an excessive effort. Upon your request, we will inform you about to whom the information has been shared.

Right to deletion

As a customer, you are always entitled to contact us and request that your personal data be deleted. In the following cases, personal data must be deleted:

  • If personal data is no longer needed for the purposes we have collected and processed them for;
  • If your treatment is based solely on your consent and you revoke this consent;
  • If the treatment is for direct marketing and you oppose the processing of personal data;
  • If you oppose the personal data processing that takes place after a balance of interest and there are no legitimate reasons that takes precedence over your interest;
  • If personal data are not processed according to the regulations;
  • If deletion is required to fulfill a legal obligation.

Right to limit treatment

You may, in some cases, require that we limit the processing of your personal data. By limitation is meant that the personal data will be marked so that in the future they can only be processed for certain limited purposes.

The right to limitation applies, for example, if you believe that your personal data is incorrect and has requested a correction. In such cases, you may also request that our processing of your personal data be limited while investigating the accuracy of the personal data.

Right to object

You are entitled to object to the processing of your personal data as we do based on balance of interest. In that case, you need to specify what treatment you opposes. In such an objection, we may continue to process the treatment only if we can show that there are compelling justifying reasons why your personal data must be treated that takes precedence over your interests.

If your personal data is processed for direct marketing, you are always entitled to opt-out (unsubscribe) at any time.

You have the right to request that we provide your Personally Identifiable Information to a third party provider's data controller.
